1. Purpose

Timber respects intellectual property and the investment involved in creating and maintaining the content available on this website.

This Artificial Intelligence & Website Content Use Policy sets out the restrictions that apply to the use of content from this website by artificial intelligence systems, large language models, generative AI platforms, machine-learning systems, automated agents, web crawlers and other automated technologies.

Unless expressly authorised by Timber in writing, no content on this website may be collected, copied, reproduced, downloaded, extracted, stored, processed, analysed, indexed, used as training data or otherwise used by any artificial intelligence or machine-learning system.

2. Protected Website Content

For the purposes of this Policy, "Website Content" includes all content made available through the Timber website, including but not limited to:

  • Written text and copy;

  • Product descriptions and specifications;

  • Product names and information;

  • Product pricing and product data;

  • Images, photographs and graphics;

  • Product photography;

  • Videos and other visual media;

  • Logos, trademarks and branding;

  • Website designs and layouts;

  • Blog posts, articles and editorial content;

  • Guides, resources and educational material;

  • Customer reviews and testimonials;

  • Metadata and structured product information;

  • Collections and catalogue information;

  • Website source content and other material;

  • Any databases or compilations of the above; and

  • Any other material published or made available on the website.

3. Prohibition on Artificial Intelligence Use

Unless Timber has provided prior written permission, you must not use any Website Content for the purpose of:

3.1 AI Training

  • Training an artificial intelligence model;

  • Training a large language model (LLM);

  • Training a generative AI model;

  • Training a machine-learning or deep-learning system;

  • Fine-tuning, adapting or improving an AI model;

  • Creating or expanding an AI training dataset; or

  • Creating embeddings, vector databases or other machine-readable representations for AI systems.

3.2 AI Content Generation

You must not use Website Content as input, reference material or source material for generating:

  • AI-generated text;

  • AI-generated images;

  • AI-generated video;

  • AI-generated audio;

  • AI-generated product descriptions;

  • AI-generated marketing material; or

  • Other content generated by artificial intelligence.

3.3 Data Collection and Scraping

You must not use automated systems, bots, crawlers, scrapers, agents, APIs or other automated methods to collect, harvest, copy or extract Website Content for use by an artificial intelligence or machine-learning system.

This restriction applies whether the content is collected:

  • Manually or automatically;

  • In full or in part;

  • Temporarily or permanently;

  • Directly from the website or through another service;

  • From publicly accessible pages or restricted areas; or

  • Through a third-party service, intermediary or automated agent.

4. AI Crawlers and Automated Agents

Timber does not grant permission for AI systems, AI crawlers, AI search engines, automated agents or other machine-learning systems to crawl, scrape, index, collect or process Website Content for AI training, dataset creation, model development or similar purposes.

The absence of a technical restriction, including the absence of a robots.txt directive, does not constitute permission to use Website Content for these purposes.

Timber may implement technical measures designed to identify, restrict or prevent unauthorised automated access to the website.

5. No Licence for AI Training

Access to or use of the Timber website does not grant any licence, permission or other right to use Website Content for:

  • Artificial intelligence training;

  • Machine-learning training;

  • Dataset development;

  • Generative AI development;

  • Model evaluation;

  • Model fine-tuning;

  • AI product development; or

  • Any substantially similar purpose.

Any rights not expressly granted by Timber are reserved.

6. Copyright and Intellectual Property

Unless otherwise stated, Website Content is owned by, licensed to or otherwise controlled by Timber and may be protected by copyright, trade mark, design rights, confidential information rights and other intellectual property laws.

Nothing in this Policy transfers ownership of any Website Content to you or to any artificial intelligence provider, developer, platform or third party.

You must not remove, obscure or alter copyright notices, trade marks, watermarks, attribution or other intellectual property notices contained within Website Content.

7. Product Information

Timber's product names, descriptions, specifications, images, dimensions, materials, features, pricing and other product information must not be systematically collected or reproduced for the purpose of creating or operating an artificial intelligence system, dataset, catalogue, comparison engine or automated commercial service without Timber's prior written permission.

This restriction includes using automated systems to create competing product listings, catalogues or product databases based substantially on Timber's Website Content.

8. Images and Visual Content

All photographs, product images, graphics, illustrations, logos and other visual content on the website are protected from unauthorised reproduction and use.

Without prior written permission, you must not submit, upload, scrape, copy or otherwise provide Timber images or visual content to an artificial intelligence image-generation, image-analysis, computer-vision or machine-learning system for the purpose of:

  • Training an AI model;

  • Generating derivative content;

  • Creating synthetic product imagery;

  • Creating competing commercial imagery;

  • Building an image dataset; or

  • Developing or improving an AI system.

9. AI Search Engines and AI Assistants

Timber does not authorise Website Content to be used as training material or source material for AI-generated answers, summaries, recommendations, shopping assistants or other generative AI outputs beyond uses that are expressly permitted by applicable law.

AI platforms, search engines, shopping assistants and automated agents must not systematically collect or reproduce Timber Website Content for these purposes without prior written permission.

10. Third-Party AI Services

You must not submit Timber Website Content to third-party artificial intelligence services for processing, analysis, training or generation where doing so would breach this Policy or Timber's intellectual property rights.

This includes, without limitation:

  • Chatbots;

  • Generative AI platforms;

  • AI writing tools;

  • AI image-generation platforms;

  • AI research tools;

  • AI shopping assistants;

  • AI training platforms; and

  • Other machine-learning services.

11. Automated Access

The following activities are prohibited where undertaken for a purpose restricted by this Policy:

  • Web scraping;

  • Data scraping;

  • Crawling;

  • Automated browsing;

  • Bulk downloading;

  • Automated copying;

  • Content harvesting;

  • Dataset creation;

  • API harvesting;

  • Automated product extraction;

  • Automated image extraction; and

  • Use of AI agents or autonomous browsing systems.

Timber reserves the right to block or restrict automated access where it reasonably considers such access to be unauthorised or harmful.

12. Exceptions

Nothing in this Policy is intended to prohibit activities that cannot lawfully be restricted under applicable law.

Nothing in this Policy excludes or limits rights that cannot legally be excluded or limited, including applicable rights under Australian copyright and consumer protection legislation.

Limited uses may also be permitted where Timber has provided express written authorisation.

Any permission granted by Timber must be obtained in writing and may be subject to conditions, limitations, attribution requirements and/or licensing fees.

13. Requesting Permission

If you wish to use Timber Website Content in connection with an artificial intelligence system, dataset, research project, commercial service or other automated technology, you must obtain written permission before doing so.

Permission requests should include:

  • Your name and organisation;

  • The AI system or technology involved;

  • The specific Website Content you wish to use;

  • The proposed purpose;

  • How the content will be collected and stored;

  • Whether the content will be used for commercial purposes;

  • Whether the content will be used to train or improve an AI model; and

  • The proposed duration of use.

14. Enforcement

Timber reserves all rights available under applicable law in relation to unauthorised use, reproduction, copying, extraction, distribution or exploitation of Website Content.

Where Timber becomes aware of unauthorised use of Website Content by an AI system, automated service, developer or other party, Timber may take any action it considers appropriate, including:

  • Requesting removal of the content;

  • Requesting deletion of copies or datasets containing the content;

  • Blocking automated access;

  • Issuing a cease-and-desist notice;

  • Seeking compensation or other remedies;

  • Reporting infringement to relevant platforms or service providers; and

  • Taking legal action where appropriate.

15. Changes to This Policy

Timber may update this Policy from time to time to reflect changes in technology, legislation, website functionality or business practices.

The latest version will be published on this website with the updated effective date.
